Limited Warranty:

Your Barina Craft handcrafted home bar furniture is destined to become a treasured part of your family heirlooms. We believe strongly in the quality and integrity of our workmanship and want you to be truly pleased. Should your furniture fail at any time during the warranty period, because of manufacturer's defect, Barina Craft will repair or replace it at our discretion. If Barina Craft determines that the issue in question is covered by warranty, and that repair is impractical, you will be furnished a replacement product of the same or similar color, design, style and quality. To exercise your rights under this warranty, you must submit the original sales receipt when making a claim and you must be the original owner. Submit your claim in writing to:

Warranty Terms

Subject to the limitations, exclusions and disclaimers set forth below, which are expressly incorporated herein, Barina Craft warrants its products to be free from manufacturer's defects for a period of one (1) year beginning at the time you receive the product in your home (the "Warranty Period").

Limitations and Exclusions

This warranty shall apply only if (i) Purchaser notifies Seller in writing with a detailed description, date of occurrence and includes photographs clearly showing the nature of the claimed defect within ten (10) days of discovery; (ii) Purchaser discovers the claimed defect within the Warranty Period; (iii) Purchaser allows Seller or its representative to inspect the Goods claimed to be defective; and (iv) Seller confirms the defect in writing to Purchaser. This Barina Craft Limited Warranty extends only to manufacturer's defects in materials and workmanship which occur during "Household Use" as defined below, and it does not apply to: (a) Goods that have not been maintained in accordance with instructions or that have been accidentally damaged; (b) defects attributable in any way to installation, modification or repair made by any party other than Barina Craft or an authorized Barina Craft representative; or (c) mishandling, accident, fire, flood, earthquake, lightning, or other hazards whether natural or man-made, or shipment.

During the Warranty Period, if a Barina Craft product does not conform to this limited warranty, the purchaser's sole and exclusive remedy against Seller arising out of or in connection with any claimed defect in any Goods sold hereunder, whether based upon contract, strict liability or negligence, and whether for personal injury or other monetary loss, shall be at Barina Craft's option and sole discretion, is one of the following:

(a) Repair of the defective component or product.
(b) Replacement of the defective component or product.

The repair or replacement of the furniture does not extend the duration of the Warranty Period nor begin a new Warranty Period. A perfectly matched repair cannot be guaranteed. Replaced item(s) become the property of Barina Craft.

Household Use
This warranty applies only when you have purchased Barina Craft home bar furniture for your own normal indoor household use and not for resale or commercial use, which includes without limitation, rental, business, commercial, institutional or any other non-residential use.

Improper Care and Use
Your Barina Craft furniture requires some routine maintenance to maintain its beauty and structural integrity. Please take care to treat your Barina Craft home bar item like the fine furniture it is. Proper care and use are essential to preserving your rights under this warranty. For complete instructions, please refer to our wood furniture care and use brochure. Barina Craft will not repair or replace your furniture if improper maintenance or improper use causes damage. This warranty does not apply if your Barina Craft product is damaged by the use of detergents, abrasives or other improper cleaning agents. Furniture finishes are not warranted or guaranteed in any way from damage from heat, water and other fluids, chemicals, scratches, dents, or abrasions, etc.

Accidents, Abuse and Normal Wear and Tear
This warranty does not cover damage resulting from negligence, abuse, normal wear and tear, or accidents: including burns, cuts, scratches, tears, scuffs, watermarks, sun damage, extreme temperatures and/or humidity, indentations or pet damage. Damage occurring during the delivery, installation, set up or storage of your Barina Craft furniture is not covered by this warranty and should be addressed with the party making delivery, installation and/or storage.

Product Modification
This warranty shall not apply if (a) Purchaser or a third party modifies or repairs the Goods without Barina Craft's prior written approval; or (b) after discovery of a defect, Purchaser fails to take prompt and reasonable steps to prevent the defect from becoming more serious.

Differences From Floor Displays or Literature
This warranty does not cover products designated "AS IS" at the time of purchase.  Because of craftsmanship or use of natural materials in Barina Craft furniture, minor variations in color, wood grain, or construction can occur from piece to piece.  Therefore, this warranty does not cover such minor differences, or differences between floor samples or printed illustrations and your furniture.  Variations in grain, color, marks, scars, texture and pattern of wood, leather and textiles may occur as a result of nature, dye lot, exposure to light, and aging. Barina Craft makes no warranty with respect to matching of grain, textures, pattern or colors of such materials, including an exact match to wood chips, color samples, or swatch cards.

Consumer Warning Against Tipping
Furniture may tip over.  Home bars and other furniture pieces may have a high center of gravity and should be securely fastened to the floor or appropriate mounting surface to help reduce the risk this might happen.  This warranty does not apply to nor guarantee against tipping over regardless of whether your product was restrained.  Never allow children or adults to climb on this furniture.

DISCLAIMER OF WARRANTIES
IN NO EVENT, WHETHER BASED IN CONTRACT OR TORT OR OTHER LEGAL THEORY, SHALL BARINA CRAFT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION, LOSS OR DAMAGES TO OTHER PROPERTY, WHETHER DIRECT OR INDIRECT, INCONVENIENCE, FINANCIAL LOSS, LOSS OF USE OF THE PRODUCT, PERSONAL INJURY DAMAGES, CLAIMS FOR DAMAGES RESULTING FROM THE USE OF THE PRODUCT OR THIRD PARTY CLAIMS AGAINST YOU FOR DAMAGES.  SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES OR ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.  IN NO EVENT SHALL BARINA CRAFT'S TOTAL AGGREGATE RESPONSIBILITY EXCEED THE PURCHASE PRICE PAID, IF ANY, FOR THE PRODUCT OR ITS REPLACEMENT.

LIMITATION OF LIABILITIES
THIS LIMITED WARRANTY AND REMEDY ARE EXCLUSIVE AND MADE ONLY TO THE ORIGINAL PURCHASER.  BARINA CRAFT MAKES NO OTHER EXPRESS, IMPLIED OR STATUTORY WARRANTY OR REPRESENTATIONS, INCLUDING WITHOUT LIMITATION,  ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ALL SUCH WARRANTIES ARE HEREBY EXPRESSLY EXCLUDED.

Miscellaneous
This warranty is not renewable or transferable.  Barina Craft's failure to exercise certain rights under this warranty does not waive those rights.  Valid to the original purchaser only in the continental United States.  If any provision contained herein is found to be contrary to law, then such provision(s) shall be constructed in a manner to closely reflect, as much as possible, the intentions of the parties, with the other provisions remaining in full force and effect.

Your Warranty Rights

This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state.  Except for such other rights, the remedies provided under this warranty state the limit of Barina Craft’s responsibilities.
